The Resale Restriction limits the price you can resell the house for and the amount of equity it can build. The difference between the home's fair market value and the maximum restricted resale price is known as “Excess Sales Proceeds.” This amount belongs to the program, and the City records a note and deed of trust to protect those proceeds. You are free to hire an attorney to help you understand the program you contractually agree to participate in and follow. Among other requirements and responsibilities, you will be required to complete an annual compliance certification, validating that you as the owner are still occupying the property. Renting the property will breach program requirements disqualifying you from the program.

Supporting documents for claimed city preferences:
Tier 1: If you select Tier 1, you need to upload the documents on this list to your account (Preferences Tab) by the Drawing Entry Deadline.
Tier 2: If you select Tier 2, you need to upload the documents on this list to your account (Preferences Tab) by the File Submission Deadline.
You must also verify that your address of residence AND/OR your work address is within the City of Hayward city limits by looking up your address on the GIS Hayward web map.
To do this:
1. Click on the URL https://webmap.hayward-ca.gov/
2. Enter your current residence or work address in the “Search By Address” field in the format indicated, then click “Find”.
3. Scroll down the page until you see the line that says “Jurisdiction”. This line must say “City of Hayward”.
4. Print the page as proof of verification and upload it to your account.
